THIRD-PARTY SERVICES

We disclaim responsibility for third-party services, hosting providers, payment processors, or other external dependencies that may affect your website's performance.

MARKET CONDITIONS

Digital marketing and SEO results are subject to algorithm changes, market conditions, and competitive factors that we cannot control or predict.

6. Limitation of Liability

Maximum Liability Cap

In no event shall Webtreta's total liability for any claims arising from or related to our services exceed the total amount paid by you for the specific services that gave rise to the claim, or $5,000 USD, whichever is less.

Excluded Damages

We are not liable for:

Your Responsibilities

7. Termination

Termination by You

Project-Based Services

You may terminate active projects with 7 days written notice. You will be charged for work completed up to the termination date.

Recurring Services

Monthly services can be cancelled with 30 days notice. Annual contracts may have early termination fees as specified in your agreement.

Termination by Us

We may terminate services immediately if you:

  • • Fail to pay invoices after 30 days
  • • Engage in prohibited activities
  • • Provide false or misleading information
  • • Become abusive or threatening to our team
  • • Request services outside our capabilities

Effects of Termination

Immediate Effects

Data & Files

  • • 30 days to request your data
  • • Completed work delivered as-is
  • • Source files transferred if paid
  • • Backups deleted after 90 days

Ongoing Obligations

  • • Confidentiality remains in effect
  • • IP restrictions continue
  • • Payment obligations survive
  • • Warranty terms still apply

8 Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. For international clients, we will work to resolve disputes under mutually acceptable jurisdiction.

Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Nagpur, Maharashtra, India, and both parties consent to the jurisdiction of such courts.

Dispute Resolution Process

First, contact us directly to discuss the issue. Most disputes can be resolved through good faith communication and negotiation.

Formal Notice

If direct communication fails, send a formal written notice detailing the dispute and proposed resolution. We have 30 days to respond.

If we cannot resolve the dispute directly, we agree to attempt mediation through a mutually agreed upon mediator before pursuing legal action.

Only if all other methods fail may either party pursue legal remedies through the appropriate courts as specified above.
